Harwich Conservation Commission Continues Disputed Hoyt Road Addition, Hears Petition Previews

HARWICH — April 1, 2026 — Harwich Conservation Commission heard previews of three environmental citizens' petitions and continued a contested waterfront addition case at its April 1 meeting. Petitioner Patrick Otten presented home rule articles on second-generation anticoagulant rodenticides, a fertilizer reduction bylaw, and a tree preservation ordinance headed to Town Meeting on May 4 at 6 p.m. at the Harwich Community Center; the commission was barred by a temporary town manager policy from commenting or voting on the articles. On the most contested item, homeowners Tom and Judy Lane of 80 Hoyt Road learned that a newly identified coastal bank places their proposed 18-by-16-foot room addition inside the town's zero-to-50-foot no-disturb zone, a 2014 Town Meeting bylaw that prohibits new structures; Conservation Agent Amy told the Lanes, "I would love to be able to say that this is approvable," but said she could not recommend it. The commission continued the Hoyt Road case to May 6 to allow the owners and their engineer, Grady Engineering, to explore removing existing structures from within the buffer to achieve no net increase. The commission also voted 5-0 to continue an RDA for 5 and 9 Strandway to April 15 pending minor plan revisions, accepted a withdrawal without prejudice on a pier application at 37 Nans Road, and approved orders of conditions for 140 Clearwater Drive and 6 Panorama Point Drive.
