Harwich Bylaw Charter Review Committee Flags Petition Articles, Reorganizes Leadership

Harwich Bylaw Charter Review Committee reviewed more than a dozen citizen petition articles for the upcoming town meeting warrant at its first meeting since August 2025. The three-member panel — barely at quorum — reorganized Tuesday, re-electing Linda as chair and Sandy as vice chair, then worked through a KP Law memorandum flagging legal and charter concerns with multiple articles. A petition by Matt Sutvin to limit dual board service was found to lack proper bylaw language and conflict with the charter; the Select Board had already voted to indefinitely postpone it.

Proposals involving a leaf blower ordinance, tree warden oversight, and Chapter 40B financial incentives were similarly identified as improperly formed or in conflict with state law. An Affordable Housing Trust petition was found legally permissible in form but described as undercutting the trust's core purpose of acting "between town meetings without the vote of town meeting." Members also noted the parallel Harwich Charter Commission has been meeting weekly since June 2025 and is working from a redlined draft — and that the advisory committee, which "can be ignored," intends to ask the Select Board for at least one new appointment to maintain quorum.
